Management, Compliance Department, and Employees/Sales Partners each have defined responsibilities to maintain UDAAP compliance.
6. Marketing & Sales Conduct Requirements
Prohibits misrepresentation, unclear disclosures, and unapproved materials. Requires accuracy and transparency.
7. Underwritting & Application Practices
Soft/hard pull disclosures, no coercion, and truthful communication.
8. Servicing, Collections & Customer Interactions
Requires respectful behavior, accuracy, lawful collections, and clear communication.
9. Complaint Management
All complaints must be logged, reviewed, escalated, and resolved promptly with proper documentation.
10. Training Requirements
Annual training, onboarding training, and documentation of compliance training.
11. Third-Party & Partner Oversight
Aureon Capital Partners must monitor resort partners and vendors and enforce compliance requirements.
12. Monitoring & Auditing
Compliance reviews, audits, call monitoring, marketing reviews, and periodic assessments.
13. Recordkeeping
Required retention of key documents for a minimum of 5 years.
14. Enforcement & Corrective Action
Outlines disciplinary steps and remediation for consumer harm.
15. Policy Review
Annual review or updates following regulatory or operational changes.
16. Certification
All employees and partners must acknowledge reading and accepting the policy.
